I am filing complaint to the Commercial Court of Appeal in Belgrade against the decision made by the judge Goran Crevar

The first-instance judgement made by the judge Goran Crevar from the Commercial Court in Novi Sad was published at the end of last week and it cretaed suspicions that the judgement was result of the pressure coming from political-banking circles.

Namely, my claim for defining if the mortgage on the newly-built facilities of ATP Vojvodina registered by the Bank in 2008 was legal has been rejected with the explanation that none of the trustees disputed that during the bankruptcy procedure. Practically, the Court which was prolonging the procedure for two years, demading two expertises and made a lot of expenses, got back to the starting position – instead of defining if the mortgage was properly registered (that was the subject of the claim), the judge decided that the bankruptcy court had made that conclusion in 2011.

I am not going to make any comments relating the judgement, but I will use all the legal means to make the court clearly say if the mortgage was legally registered in the Cadastre or not. I will file the complaint to the Commercial Court of Appeal.

It is clear to me that the obstacle to a direct answer to this question are all the pressures and interests which can and have already been appearing. I have made a time connection with the coming hearing for the bankruptcy procedure for ATP Vojvodina scheduled for 18 December 2019, when the Court has to decide if the reorganization will be continued or bankruptcy will be declared. In case of the latter option, selling of the company would satisfy only the demands of Credit Agricole Bank, for the reason of its having the status of secured creditor it got when the compromized mortgage was registered. The Bank has tried ten times so far to sell the Setra and Mercedes Service which is the most important part of the investment, and it will probably continue to try the same to the detriment of all other creditiors. The person especially insisiting on that is one of the directors of Credit Agricole Bank - Aleksandar Divljak, whose brother is interested in buying the Service Centre.

I would like to remind you that, because of illegally registered mortgage, I filed criminal charges to the Higher Prosecutor's Office in Novi Sad where the Prosecutor in charge is Gordana Rainović, to the Anti-corruption Section against the responsible persons in the Bank and Cadastre. This judgement made by the Commercial Court which has not solved the problem of legality of the mortgage will significantly help the charged ones, although it has been coming from the case documents and the expert findings that there was no legal basis for the mortgage registration.

We will see in which way the Prosecutor's Office is going to act in the case in which the bankruptcy is not the subject, but the subject is illegally regsitered mortgage.
